Terms and Conditions for the University of Bayreuth Alumni and Career Portal


(A) General Provisions

(1) Introduction and Scope

 

(1a) The General Terms and Conditions (GTC) for the University of Bayreuth Alumni and Career Portal apply to all current and future business relationships with the University of Bayreuth’s Career Service and Corporate Relations Office (hereinafter: KUK) in connection with the University of Bayreuth Alumni and Career Portal (hereinafter: KUK websites). They apply equally to business entities (Section 14 of the German Civil Code (BGB)) and consumers (Section 13 of the German Civil Code (BGB)).

(1b) Users within the meaning of these Terms and Conditions are natural or legal persons or
partnerships with legal capacity with whom a business relationship is established.

(1c) Partners, as defined in these Terms and Conditions, are users who generally provide content on KUK websites and within the scope of KUK content—content typically directed at students and/or alumni of the University of Bayreuth—for commercial purposes within the meaning of § 14 BGB.

(1d) Members, as defined in these Terms and Conditions, are users who are not Partners as defined in these Terms and Conditions.

(1e) KUK maintains KUK websites through which its members can network and access information from KUK, and through which additional services—such as news, member benefits, jobs, and events—are provided.

(1f) Within its KUK websites, KUK operates a closed members-only area as well as subpages for networks (clubs, communities, etc.).

(1g) The KUK websites offer registered members access to the members-only area, discussion forums, and future enhancements to the members-only area or new services.

(1h) By providing the Alumni and Career Portal, KUK pursues the following objectives:

to support students in their transition from college to the workforce,
to facilitate networking among students, alumni, companies/institutions, and the University of Bayreuth,
maintaining contact with the University of Bayreuth and fostering loyalty to it,
providing career services for alumni,
organizing events both on and off the University of Bayreuth campus,
pooling and sharing knowledge and expertise,
supporting campus communities and initiatives that also pursue these goals.


(2) Conclusion and Termination of the Contract

(2a) Conclusion of the Contract

(2aa) Registration is required to use the KUK websites. Upon completion of registration, the user submits a binding offer to enter into a user agreement. The contract is concluded as soon as KUK confirms the registration or grants access to the website.
(2ab) The information requested during registration must be provided completely and truthfully. The user must update any changes to this information immediately. Accounts are non-transferable and may only be used personally by the respective user.

(2ac) Membership is open only to natural persons with full legal capacity who are at least 18 years of age. Minors or persons with limited legal capacity may become members only with the consent of their legal representative.

(2ad) The user agreement with members is free of charge. The user agreement with partners is free of charge unless otherwise agreed.

(2ae) There is no contractual right of withdrawal.

(2b) Termination of the Agreement

(2ba) Unless a fixed term is expressly agreed upon, the user agreement is concluded for an indefinite period.

(2bb) Either party may terminate the contract at any time with [e.g., two weeks'] notice to the end of the month. Notice of termination must be provided in writing (e.g., via email) or may be submitted using the function provided for this purpose in the user account.

(2bc) Either party has the right to terminate the user agreement for good cause. Good cause exists, in particular, if the user breaches material contractual obligations, provides incorrect information during registration, or uses the website for unlawful purposes.

(2bd) Upon the termination taking effect, the member’s access to the members-only area will be blocked. KUK is entitled to delete or anonymize all content posted by the user.

(2be) The User Agreement terminates automatically if KUK ceases to provide the website. In this case, the user will be notified in a timely manner in advance.

(2bf) Unless otherwise agreed in writing, the agreement with partners terminates upon expiration of the agreed term of the respective service, such as a job or internship offer, or the partner’s respective advertisement or event.

 


(3) Members' Area

 

(3a) Access to the Members’ Area

(3aa) Access to the Members’ Area is restricted to members. Data from the Members’ Area may only be used for personal purposes and may not be disclosed to third parties or used for purposes that are not consistent with KUK’s objectives.

(3ab) Access automatically expires upon termination of membership, effective as of the date the termination takes effect.

(3ac) The password chosen during registration must be kept confidential and must not be disclosed to third parties. KUK employees will never ask users for their password. Users are prohibited from allowing third parties to use the KUK network. Users are obligated to inform KUK immediately if there is reason to suspect that a third party has knowledge of their login credentials and/or is misusing an account.

(3b) Content and Features of the Members’ Area

(3ba) Members enter their own profile information. KUK approves the profile.

(3bb) KUK cannot technically verify with certainty whether a user registered on the KUK websites is actually the person they claim to be. KUK makes no warranty regarding a user’s actual identity.

 


(4) General Obligations of the User

 

(4a) The user agrees to

(4aa) provide only true and non-misleading information in their profile and in their communications with other users, and to immediately update any changes to their login information in their account settings. The user may make these updates at any time under “My Profile.”

(4ab) to upload to the KUK website only content (e.g., photos of people, events, texts) that may be publicly displayed. With regard to member photos under “My Profile,” the uploading of photos or images of other people, nonexistent people, or other beings (animals, fantasy creatures, etc.) is not permitted.
(4ac) To comply with applicable laws and all third-party rights when using the content and services on the KUK websites. In particular, the user is prohibited from

using the information for purposes that are not compatible with KUK’s objectives;
uploading and/or using offensive or defamatory content, regardless of whether such content concerns other users, KUK employees, or other individuals or companies;
to use content that is pornographic or violates laws protecting minors, or to advertise, offer, or distribute products that are pornographic or violate laws protecting minors;
to unreasonably harass other users (particularly through spam), especially for commercial, political, or religious purposes;

to use content protected by law (e.g., by copyright, trademark, patent, design, or utility model law) without authorization, or to advertise, offer, or distribute goods or services protected by law; and
to engage in or promote anti-competitive practices, including progressive customer recruitment (such as chain letters, snowball schemes, or pyramid schemes).

(4ad) to refrain from the following harassing actions, even if they do not specifically violate any laws:

Mass distribution of chain letters, spam, promotional emails, or information unrelated to the University of Bayreuth or KUK; Conducting, advertising, and promoting sales activities (such as multi-level marketing or multi-level network marketing) or
suggestive or sexually explicit communication (explicit or implicit)
Mass mailings not authorized by KUK
Collecting or copying other users’ contact information for the purpose of mass mailings (digital or in writing)

(4b) Users are prohibited from the following actions:

The use of mechanisms, software, or scripts in connection with the use of the KUK websites. However, the user may use the interfaces or software made available to him by KUK as part of the services offered on the KUK websites.
Blocking, overwriting, modifying, and copying, unless necessary for the proper use of the services of the KUK websites. Copying via “robot/crawler” search engine technologies is expressly prohibited.
Distribution and public communication of content from the KUK websites or from other users,
any action that is likely to impair the functionality of the KUK infrastructure, in particular by placing an excessive load on it.

 

(5) Responsibility for Content

 

(5a) KUK is solely responsible for the content it creates. This excludes, in particular, information based on data provided by third parties.

(5b) KUK assumes no responsibility for content, data, and/or information provided by users of the KUK websites or by third parties, nor for content on linked external websites. In particular, KUK does not guarantee that such content is accurate, fulfills a specific purpose, or is capable of serving such a purpose.

(5c) If a user notices any use of the KUK websites that violates the law or a contract, they may report it by email to: karriereservice@uni-bayreuth.de.

 

 

(6) Availability of the KUK Websites

 

(6a) For online and Infoscreen services, KUK will endeavor to make the booked service available for access with as little interruption as possible. However, even with the utmost care, downtime cannot be ruled out.

(6b) Lack of availability and changes to the University of Bayreuth KUK website do not entitle the user to a price reduction or withdrawal from the contract, provided that the user’s interests are not unreasonably impaired as a result.

(6c) KUK reserves the right to modify or discontinue its services at any time, provided that this is reasonable for the user, taking the user’s interests into account. If KUK discontinues the service in accordance with the first sentence above, the user will be reimbursed for services already paid for but not yet received.

 


(7) Data Protection

 

(7a) Protecting users’ personal data is a top priority for KUK. Data processing is carried out exclusively in accordance with the applicable data protection regulations of the European Union, in particular the General Data Protection Regulation (GDPR), as well as the Federal Data Protection Act (BDSG).

(7b) Personal data is collected, stored, and used only to the extent necessary to establish, perform, or terminate the user agreement, or where the user has given explicit consent. This includes, in particular, registration data as well as usage and communication data generated in connection with the use of the KUK websites.

(7c) Personal data will be disclosed to third parties, in particular to partners, only to the extent necessary to fulfill the contract, in accordance with KUK’s objectives, where a legal obligation exists, or where the user has expressly consented. KUK does not disclose personal data for commercial purposes to third parties who are not users as defined in these Terms and Conditions.

(7d) Users have the right at any time to obtain, free of charge, information about the personal data stored by KUK. In addition, they may request the correction of inaccurate data as well as the restriction of processing, erasure, or transfer of their data, provided that no statutory retention obligations preclude such actions.

 
(8) Liability and Indemnification

 

(8a) KUK is liable only for damages resulting from injury to life, limb, or health that are attributable to an intentional or grossly negligent breach of duty by KUK.

(8b) In all other respects, KUK is liable only for damages resulting from a grossly negligent breach of duty by KUK or from an intentional or grossly negligent breach of duty by a legal representative or agent of KUK.

(8c) Subject to (8a) and (8b), KUK assumes no liability for content provided by other users on the website. Users are solely responsible for the content they post and must ensure that it does not infringe upon the rights of third parties.

(8d) Subject to (8a) and (8b), KUK assumes no liability for interruptions or disruptions to the website due to technical problems, maintenance work, or force majeure. However, KUK will endeavor to ensure the availability of the website to the greatest extent possible.

(8e) The user indemnifies KUK against all claims, including claims for damages, that other users or other third parties may assert against KUK due to an infringement of their rights by content posted by the user on the KUK websites. The user further indemnifies KUK against all claims, including claims for damages, that other users or other third parties may assert against KUK due to an infringement of their rights resulting from the user’s use of the services on the KUK websites. The user shall bear all reasonable costs incurred by KUK as a result of a violation of third-party rights, including reasonable costs incurred for legal defense. All further rights and claims for damages on the part of KUK remain unaffected.
The user’s obligations set forth above shall not apply to the extent that the user is not responsible for the infringement in question.

(8f) If the user’s content infringes the rights of third parties, the user shall, at KUK’s discretion, secure the right to use the content at the user’s own expense and adapt the content to comply with the law. If the user’s use of the services on the KUK websites infringes the rights of third parties, the user shall immediately cease such use that is in breach of the contract and/or unlawful upon request by KUK or the third party.

 


(9) Legal Effectiveness

 

(9a) Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The contracting parties undertake to replace an invalid provision with a valid provision that, in its substance, comes as close as possible to the intended meaning and purpose of the invalid provision. This applies mutatis mutandis to any gaps in the contract.

(9b) Any ancillary agreements or agreements deviating from these provisions must be in writing.

(9c) The law of the Federal Republic of Germany and the European Union shall apply exclusively to all legal relationships between the contracting parties.

(9d) The place of performance and venue is Bayreuth.

(9e) KUK reserves the right to amend these Terms and Conditions at any time without stating reasons. KUK will notify the user of any changes to the Terms and Conditions in a timely manner. If the user does not object to the validity of the new Terms and Conditions within two (2) weeks of receiving the notification, the amended Terms and Conditions shall be deemed accepted by the user. KUK will inform the user in the notification of their right to object and the significance of the objection period.

 


(10) Miscellaneous

 

(10a) The German-language
version of these Terms and Conditions is the legally binding version.

(10b) Contacting KUK

(10ba) The user may contact KUK using the contact information provided on the website, in particular:

(10bb) Communication should be in writing or electronically. Inquiries made by phone will be answered whenever possible; however, they do not establish a formal deadline or obligation on the part of KUK.

(10bc) KUK endeavors to respond to inquiries in a timely manner. However, there is no entitlement to immediate processing.

(10bd) The user agrees to provide complete and accurate information in inquiries (e.g., name, membership number, email address) so that KUK can process the inquiry. Incomplete inquiries cannot be processed by KUK.

(10be) Contacting KUK through the specified channels does not establish any legal claims to specific services or changes to the user agreement.

 

 

(B) Special Provisions


(1) Individual counseling sessions at KUK

 

(1a) KUK individual counseling sessions take the form of counseling meetings.

(1b) Unless otherwise agreed, the following deadlines apply to the user for counseling meetings:

Registration must be completed at least 3 days (72 hours) before the counseling appointment;
Submission of documents no later than 3 days (72 hours) before the consultation appointment (unless already required at the time of booking);
Cancellation no later than 3 days (72 hours) before the consultation appointment.

(1c) If the requested documents are not received by the deadline, KUK is entitled to cancel the consultation sessions.

 

 

(2) KUK Events and Workshops

 

(2a) Users may participate in KUK events and workshops, which take place either on the University of Bayreuth campus or off-campus.

(2b) Unless otherwise agreed, the following deadlines apply to users for KUK events and workshops:

Registration by Monday at 8:00 a.m. in the week of the event.
Cancellation by Monday at 8:00 a.m. in the week of the event.

(2c) For events and workshops that KUK organizes through a third-party provider, that provider’s terms and conditions of participation may apply.

(2d) The user is solely responsible for ensuring adequate insurance coverage.

 

 

 

(3) Company events and workshops

 

(3a) Users may apply for events and workshops organized by companies, which may be held either at the company’s premises, on the University of Bayreuth campus, or off-campus.

(3b) For events and workshops organized by companies that are held at a third-party venue, the third party’s terms and conditions of participation may apply.

(3c) In addition to the provisions of these Terms and Conditions, additional terms and conditions set by the companies may apply to events and workshops. The companies are responsible for communicating these additional terms and conditions.

(3d) The user acknowledges that the respective companies are responsible for the content of the events and workshops.

(3e) The contracting party acknowledges that the respective companies conduct the selection process and that KUK has no influence over it.

(3f) For events and workshops organized by companies, the deadlines for applications or registrations specified in the events or workshops apply. If no deadlines are specified, the following deadlines apply to the contracting party:

Registration/application by 14 days before the start of the event;
Cancellation/withdrawal by 14 days before the start of the event.

(3g) The contracting party is solely responsible for ensuring adequate insurance coverage.

 

 


(4) No-Show Policy

 

(4a) The user is required to attend booked appointments or to cancel them within the timeframe specified on the platform, set forth in these Terms and Conditions, or agreed upon individually.

(4b) Unexcused failure to appear, unexcused tardiness, or leaving early without prior notification to the responsible KUK representative, the company, and/or the third-party provider are considered no-shows.

(4c) Every no-show is recorded by KUK and results in immediate exclusion from all future optional offerings of the Career Service.

(4d) Furthermore, more than one absence or failure to cancel in a timely manner without a valid, verifiable reason also results in immediate exclusion from all future optional offerings of the Career Service.

(4e) If a user is unable to attend an agreed-upon appointment for valid, verifiable reasons (such as an accident, illness, or job interview) and has apologized in advance for their absence, this is not considered a no-show and may be claimed by providing appropriate proof. Official proof, e.g., in the form of a medical certificate, must be submitted by email to karriereservice@uni-bayreuth.de no later than 2 days after the event or consultation, or immediately upon recovery.

 

 

(5) Compensation for Partners

 

(5a) For KUK services subject to a fee, the Partner agrees to pay the agreed-upon fee—or the fee specified at the time of booking the service—by the due date.

(5b) The fee does not include the applicable value-added tax.

(5c) The Partner must pay the fee within fourteen (14) days of the invoice date. Upon expiration of the payment deadline, the Partner shall be in default.

(5d) If the Partner defaults on payment of the invoice, KUK is entitled to suspend the provision of services until full payment has been received and to refuse future services.

 

 

(6) Trademark Rights for Partners

 

(6a) The Partner is not authorized to use the trademarks (including the logo) of the KUK or the University of Bayreuth without their express prior written consent.

(6b) The Partner may publish its trademark, and in particular its logo, on the KUK platform. The KUK assumes no liability for trademarks used by the Partner on the platform.

 

 

(7) Data Protection for Partners

 

(7a) Natural persons who create profiles on behalf of the Partner act as agents explicitly authorized by the Partner for this purpose. They may not assert any data protection rights against KUK or the University of Bayreuth. Any obligations that may arise in this regard (information, legal basis, etc.) are the responsibility of the relevant contractual partner.

(7b) The Partner agrees to handle any personal data of users to which it has access in accordance with the data protection laws applicable to it.

(7c) KUK is not responsible for any interaction between the Partner and a natural person that involves data protection issues. The Partner is solely responsible for ensuring that the relevant rights are upheld and that related obligations are fulfilled.

 

 

(8) Disclaimer of Warranty

 

(8a) KUK makes no warranty whatsoever as to whether the partner will fully achieve its objective in connection with the conclusion of a contract. In particular, KUK makes no guarantee that an employment relationship will be established between a contracting party and an applicant, or that a minimum number or minimum quality of applications will be received for the job or event advertised by the Partner.

(8b) KUK makes no guarantee whatsoever that users will honor appointments with the Partner.

 

 

(9) Visibility of Profile Information and User Responsibility

 

(9a) The portal is designed to connect its members. To this end, the information stored in a user’s profile is generally visible to other registered users of the portal.

(9b) Users have the option to control the visibility of individual profile details themselves using the settings provided. The user is responsible for selecting and sharing the data entered.

(9c) KUK assumes no liability for the visibility of information that has been shared by users or for which visibility has not been restricted via the settings.
